<p>Blueline Clients,</p>



<p>We wanted to remind you that beginning in January your background check applicants will start receiving 613 Letters.</p>



<p>The basic premise of this is that we will notify applicants when any matter of public record is found on a background check that may affect their hiring or promotion. This new practice will have little to no impact on you as an employer.</p>



<p>This is deemed a &#8220;best practice&#8221; policy that will help you as a client stay on the right side of any employee/applicant challenge or complaint as it pertains to background checks. </p>



<p><strong>One adjustment that will need to be made with this new policy is making sure a space is added to ask for email addresses from all applicants/employees for background checks beginning on January 1st 2020</strong>. This will allow Blueline Services to manage the reporting and compliance aspect of the 613 Letter. </p>



<p>A new authorization form with an added email address field is available in our system under the HELP tab. You should be able to download the new form there.</p>

<p style="text-align:left">Background screening compliance is a growing national issue. As the industry matures and evolves, so do the rules, regulations and best practices. In January, Blueline Serivces will implement a new notice called the “613 Letter” for all clients. This is deemed a “best practice” policy that will help clients stay on the right side of any employee/applicant challenge or complaint as it pertains to employment background checks. The basic premise is that Blueline Services will notify the applicant when any matter of public record is found on a background check that may affect their hiring or promotion. More details will be provided as we get closer to the implementation date, but this new practice will have little to no impact on you as an employer.  </p>



<p>The only potential adjustment will be the need for an email address for all applicants/employees (on background checks requested after January 1st, 2020) which will allow Blueline Services to manage the reporting and compliance aspect of the 613 Letter. This notice will go to the applicant or employee at the same time the potentially adverse information is reported to you the employer.  </p>

<p>The Department of Health and Human Services&#8217; (HHS) Substance Abuse and Mental Health Services Administration (SAMHSA) department has recently <a href="https://s3.amazonaws.com/public-inspection.federalregister.gov/2019-22684.pdf" target="_blank" rel="noreferrer noopener" aria-label="established (opens in a new tab)">established</a> scientific and technical guidelines for the inclusion of oral fluid specimens in the Mandatory Guidelines for Federal Workplace Drug Testing Programs using Oral Fluid (OFMG). </p>



<p>These guidelines will allow federal executive branch agencies to collect and test oral fluid specimen as a part of their drug testing programs. </p>



<p>The OFMG will be effective starting January 1st 2020. However, federal agencies will not be able to conduct oral fluid drug testing of federal employees until HHS has approved laboratories for oral fluid drug testing in accordance with the OFMG.</p>



<p>These guidelines may <a rel="noreferrer noopener" aria-label=" (opens in a new tab)" href="https://www.samhsa.gov/newsroom/press-announcements/201910290830" target="_blank">also be used</a> by agencies such as the Department of Transportation (DOT) and Nuclear Regulatory Commission (NRC) as part of their regulated drug testing programs, but these agencies must engage in separate rule-making activities.</p>



<p>This is the first time since 1986 that a specimen other than urine will be able to be used in the federal agency testing programs.</p>



<p>Some important things to take note of with these new changes:</p>



<p>-The specimen collection, laboratory analysis, and medical review of oral fluid tests will mirror existing procedures and processes currently in place for urine drug testing. <br>-Laboratories must be approved by the HHS National Laboratory Certification Program for oral fluid drug testing. Requirements for approval will largely mirror those currently in place for urine drug testing laboratories.<br>-The oral fluid specimen collections must be observed, use an FDA-cleared specimen collection device, and will require split specimen procedures using 2 separate devices.<br>-Federal agencies will be allowed to use oral fluid testing for all of the same testing reasons as currently authorized for urine drug testing and will not be required to choose between using only urine or oral fluid.<br>-An approved federal custody and control form (CCF) will be used to document the oral fluid collection and establish chain of custody of the specimen.<br>-The drug testing panel will test for the same drugs as the federal panel for urine drug testing. Cut-off levels specific to oral fluid are included in the OFMG.<br>-The OFMG contains provisions for when an individual cannot provide adequate volume oral specimen or urine specimen.<br>-The OFMG only refers to and permits lab-based oral fluid drug testing, not instant or POCT oral fluid testing.</p>



<p>It has taken many years from the first time SAMHSA publicly recognized the valuable attributes of lab-based oral fluid testing until now—announcing the proposed regulations. The agency has said that their hopes with releasing oral fluid testing options will be to help reduce time and money needed in order to maintain a drug testing program, and help eliminate the ever-growing issue of drug test cheating.</p>

<p>For those DOT members who will be a part of the Clearinghouse, below is a timeline of upcoming events happening for the Clearinghouse that you should be aware of.</p>



<p>The Clearinghouse final rule was made back in December of 2016. This rule created a drug and alcohol clearinghouse for the DOT. It also identified the roles and responsibilities of those who will be required to use the Clearinghouse. <h3 class="wp-block-heading">Fall 2019: Registration Begins</h3>



<p>This upcoming fall users will be able to create an account for the Clearinghouse that will give you access once the Clearinghouse becomes operational on January 6, 2020.</p>



<h3 class="wp-block-heading">January 6, 2020: Clearinghouse Implementation Date</h3>



<p>Mandatory use of the Clearinghouse to report and query information about driver and alcohol program violations will go into effect on this date. Employers will be required to conduct both electronic queries within the Clearinghouse and manual inquires with previous employers to cover the preceding three years.</p>



<h3 class="wp-block-heading">January 6, 2023: Clearinghouse Three-Year Mark</h3>



<p>Employers must query the Clearinghouse to satisfy the employer requirement to identify prospective drivers who have committed drug and alcohol program violations.</p>

										<content:encoded><![CDATA[<p>				The Department of Transportation (DOT) announced on Friday (11/9) that beginning in January there will be a change to the DOT drug-testing program regulation.</p>
<p>Hydromorphone, hydrocodone, oxymorphone and oxycodone are all being added to the new drug-testing panel.</p>
<p>This means that beginning in 2018, all drivers will now be tested for these four commonly abused opioids. Opioid abuse has risen dramatically in recent years, with drug overdose deaths nearly tripling<em>—a</em> large percentage being attributed to opioids, according to<a href="https://www.cdc.gov/mmwr/volumes/65/wr/mm655051e1.htm" target="_blank" rel="noopener noreferrer"> CDC statistics.</a></p>
<p>“Inclusion of these four semi-synthetic opioids is intended to help address the nationwide epidemic of opioid abuse,” the DOT said in its rulemaking notice which will be officially published in the Federal Register on Monday (11/13).</p>
<p>In addition to these four opioids, the DOT will also remove methylenedioxyethylamphetamine (MDEA) from the existing drug testing panel and add methylenedioxyamphetamine (MDA).</p>
<p>“The opioid crisis is a threat to public safety when it involves safety-sensitive employees involved in the operation of any kind of vehicle or transport,” said <a href="https://www.transportation.gov/briefing-room/dot8517" target="_blank" rel="noopener noreferrer">Secretary Elaine L. Chao</a>. “The ability to test for a broader range of opioids will advance transportation safety significantly and provide another deterrence to opioid abuse, which will better protect the public and ultimately save lives.”</p>
<p>This ruling will be effective starting <span class="aBn"><span class="aQJ">January 1, 2018. </span></span>		</p>
