<p>California and Delaware have both just passed state laws that prohibit individuals from distributing, delivering, or selling drug masking products. This also includes possessing with intent to distribute, deliver, or sell. </p>



<p>In this case, a drug masking product refers to synthetic urine or any substance designed to be added to human urine or hair for the purpose of defrauding a drug or alcohol test.</p>



<p>California and Delaware join <a rel="noreferrer noopener" aria-label=" (opens in a new tab)" href="https://www.toledoblade.com/local/politics/2019/06/05/theresa-gavarone-bill-would-ban-synthetic-urine-used-to-skirt-drug-tests/stories/20190605120" target="_blank">eighteen</a> other states that have outlawed synthetic urine to falsify drug tests. And many expect that some remaining states will soon follow suit.</p>



<p>As employment drug testing has becoming increasingly popular, so has the sale of drug masking products. &#8216;Booming&#8217; <a href="https://bluelineservices.com/urine-trouble-states-move-to-ban-synthetic-urine/" target="_blank" rel="noreferrer noopener" aria-label=" (opens in a new tab)">fake urine sales</a> have been attracting the attention of state lawmakers for quite some time now. </p>



<p>Yet companies that manufacture and sell urine are often able to operate as legal businesses by claiming that their product isn&#8217;t meant to be used to falsify drug tests. For <a rel="noreferrer noopener" aria-label="example (opens in a new tab)" href="https://www.vox.com/the-goods/2019/4/11/18302400/synthetic-urine-fake-pee-drug-test-whizzinator" target="_blank">example</a>, one fake urine manufacturer, Quick Fix, <a rel="noreferrer noopener" aria-label="states (opens in a new tab)" href="https://www.quickfixsynthetic.com/product/quick-fix-6-2-plus/" target="_blank">states</a> that their products are &#8220;to be used in accordance with all local state and federal laws and [are] not to be used for lawful administered drug tests.&#8221; </p>



<p>However, their <a rel="noreferrer noopener" aria-label="testimonial page (opens in a new tab)" href="https://www.quickfixsynthetic.com/testimonials/" target="_blank">testimonial page</a> implies that they are aware customers are using the product to pass drug tests </p>

<p>With increasing awareness surrounding new drug masking methods, cheating has becoming increasingly difficult. However you should ensure that your drug test administrators are trained on how to prevent or detect the use of drug masking or fake urine products.</p>

<p>Earlier this week, the Oakland City Council voted <a href="https://www.cbsnews.com/news/magic-mushrooms-oakland-becomes-second-us-city-to-legalize-2019-06-05/">unanimously</a> to decriminalize adult use and possession of magic mushrooms (or psilocybin) and other psychoactive plants and fungi.</p>



<p>This ruling follows Denver&#8217;s similar ruling last month that also approved the legalization of psychedelic mushrooms. </p>



<p>The psychedelic properties of these mushrooms include hallucinogens, meaning that users can see things that aren&#8217;t real while under the influence of these fungi. </p>



<p>Several people <a rel="noreferrer noopener" aria-label="testified (opens in a new tab)" href="https://www.cbsnews.com/news/magic-mushrooms-oakland-becomes-second-us-city-to-legalize-2019-06-05/" target="_blank">testified</a> in Oakland sharing how these drugs/mushrooms had helped them fight a wide array of problems including: depression, drug dependency, and post-traumatic stress disorder. With advocates <a rel="noreferrer noopener" aria-label="argued (opens in a new tab)" href="https://www.usatoday.com/story/news/2019/06/05/oakland-california-legalizes-magic-mushrooms-and-peyote/1347888001/" target="_blank">arguing</a> that these naturally-occurring drugs have been used by various cultures for hundreds of years for spiritual healing and treatment.</p>



<p>Councilmember Loren Taylor added amendments to the resolution offering guidance for users that was accepted by the council. They have advised the public to remember that these substances &#8220;are not for everyone&#8221; and urge those who seek to use these for PTSD or major depression to consult professional help before using. It is also advised that users consume the psychedelics with a friend present and in small amounts to test tolerance.</p>



<p>Like marijuana, magic mushrooms are still considered illegal under federal law. For those that wish to use these psychoactive plants within Oakland boundaries, the city councillors have <a rel="noreferrer noopener" aria-label="recommended (opens in a new tab)" href="https://www.forbes.com/sites/lisettevoytko/2019/06/05/oakland-legalizes-magic-mushrooms-second-us-city-to-do-so/#2456463765c2" target="_blank">recommended</a> that you please do so with caution and seek medical attention before attempting to self-treat with psychedelics.</p>



<p>Also similar to marijuana&#8217;s initial legalization, rules governing the use of psychedelic drugs and the workplace have not been altered with this ruling. Employers still have the right to enforce a drug-free workplace. </p>

										<content:encoded><![CDATA[<p>				A new two-in-one marijuana and alcohol breathalyzer is poised for release in select cities this fall.</p>
<p><a href="https://houndlabs.com/about/" target="_blank" rel="noopener noreferrer">Hound Labs Inc</a>, the California company who is developing this pioneering product, announced their hopeful release and claims that this new breathalyzer will be &#8220;1 billion times more sensitive than today&#8217;s alcohol breathalyzers&#8221;.</p>
<p>The new product is said to be &#8220;hypersensitive&#8221; to THC &#8211; the psychoactive ingredient in marijuana &#8211; and is meant to help make roads safer and hold drivers more accountable.</p>
<p>Hound Labs has been testing the Hound® marijuana and alcohol breathalyzer for more than three years and has found that the new device is able to detect THC for 2-3 hours after use (previously deemed the peak impairment window by<a href="https://one.nhtsa.gov/About-NHTSA/Traffic-Techs/current/Drugs-and-Human-Performance-Fact-Sheets" target="_blank" rel="noopener noreferrer"> global researchers</a>).</p>
<p>Currently, the only way to <a href="https://www.usatoday.com/story/news/nation-now/2018/08/07/pot-breathalyzers-hound-labs-marijuana/912705002/" target="_blank" rel="noopener noreferrer">test</a> drivers who appear to under the influence of marijuana is with field sobriety tests which are not always reliable. While blood or urine samples can also be taken to help determine sobriety, these test are only able to determine if a driver was high that day or week instead of at the time they were operating the vehicle.</p>
<p>The need for a device able to detect current or peak impairment in drivers who are potentially under the influence is becoming increasingly apparent. Recreational weed is now legal in <a href="https://totalreporting.com/blog/2018/07/16/recreational-marijuana-now-legal-vermont/">9 states</a> with pending legislation in others. And a survey performed last year by the <a href="https://www.codot.gov/news/2018/april/cdot-survey-reveals-new-insight-on-marijuana-and-driving" target="_blank" rel="noopener noreferrer">Colorado Department of Transportation</a> found that almost 70 percent of cannabis users drove high at least once in the past year with 27 percent stating they drive high almost everyday.</p>
<p>It&#8217;s still not certain when or if this new breathalyzer will release and where. But Hound Labs <a href="https://baltimore.cbslocal.com/2018/08/15/marijuana-breathalyzer/" target="_blank" rel="noopener noreferrer">said</a> that they hope their breathalyzer will allow &#8220;law enforcement and employers to fairly address the safety concerns associated with marijuana impairment without unjustly accusing individuals who legally and responsibly use cannabis.&#8221;</p>
